Unjust and wrongful terminations occur on a daily basis. In Ohio however not all wrongful terminations are actionable. Because Ohio follows the employee at-will doctrine an Ohio employer may discharge an employee who does not have a contract of employment for little or no reason, and escape legal liability unless in addition to being wrongful the discharge is also illegal.
Causes of action for wrongful termination arise when an employer terminates against an employee for discriminatory, retaliatory or other illegal reasons. Such claims include but are not limited to terminations based on race, sex, age, national origin, religion or disability, or because the employee has opposed practices that involve such discrimination against themselves or others. Each termination presents a separate analytical problem and must be evaluated on its own particular facts.
